1. Purpose

These Terms and Conditions of Sale and Use (hereinafter referred to as the “TCSU”) govern the relationship between Graph’Art Studio (hereinafter referred to as “we,” “our,” or “the website”) and any individual or legal entity visiting, using, or making a purchase through our website (hereinafter referred to as “you” or “the Client”).

These TCSU set out the terms and conditions for using our website, as well as the sales conditions applicable to the products offered.

Graph’Art Studio offers for sale: digital paintings sold exclusively as printed artworks, on Fine Art paper or canvas, according to the options listed on each artwork page.

Any specific request regarding a size, a support, or an option not listed on the artwork page may be reviewed on a case-by-case basis. It does not constitute a standing offer and will only be taken into account after Graph’Art Studio’s written approval.

All services and products provided by Graph’Art Studio through its website are subject to these Terms and Conditions. Any use of the website, including simple browsing, creating an account, placing orders, or accessing specific content, constitutes unconditional acceptance of these TCSU.

In addition, these Terms and Conditions define the rights and obligations of website users regarding intellectual property, personal data management, and compliance with contractual commitments.

2. Products

2.1 Ready-to-buy artworks

The artworks offered for sale on Graph’Art Studio are available exclusively in printed form.

The artworks are created and prepared by Graph’Art Studio (Blue) for high-quality printing, carried out by a reputable partner laboratory, according to the dimensions and support selected at the time of ordering.

These artworks are subject to a license, the terms of which will be detailed later. It is important to note that they are intended for personal use only. Any reproduction or distribution for commercial purposes is strictly prohibited without the Seller’s prior authorization.

2.2 Note on color differences

Please note that color variations may occur between what is displayed on a screen and the printed result. This is due to the color profile used, the color calibration of your device or monitor, as well as the nature or texture of the chosen printing medium. The Seller cannot be held responsible for differences in rendering between the digital image and the printed version.

2.3 Certificates of authenticity

Each artwork sold by Graph’Art Studio is accompanied by a certificate of authenticity attesting to its original creation. The certificate is sent by email in JPEG format, ready to be stored digitally. Each certificate is linked to a unique number and recorded in an internal register.

Some artworks may also be subject to additional individual numbering, as specified on the product page.

3. Ordering process

The Client selects the artworks of their choice on the website and proceeds to checkout.

After payment validation, the order is forwarded to our partner laboratory for production and then delivered to the address provided by the Client.

Graph’Art Studio will make every effort to meet the announced deadlines but cannot be held responsible for delays caused by circumstances beyond its control, particularly in cases of force majeure.

4. Pricing and payment

4.1 Prices

The prices of artworks offered on Graph’Art Studio, in accordance with Article L.113-13 of the French Consumer Code, are indicated in euros, inclusive of all taxes, and exclusive of delivery and shipping costs where applicable. These costs are specified before order confirmation and invoiced in addition. Delivery fees are automatically calculated at checkout, based on the weight, size, and destination of the shipment.

Graph’Art Studio reserves the right to modify its prices at any time, but artworks will be invoiced at the rates in effect at the time the Client confirms the order.

Full payment of the price is required at the time of ordering. Under no circumstances can the amounts paid be considered as deposits or advance payments.

Promotional offers, when available, are valid only for the period specified on the website, by email, or in newsletters. Any request to benefit from a promotion after its expiration date will not be accepted.

4.2 Payment

Payment for artworks is made through the secure payment methods available on the website. Full payment is required at the time of ordering. The Client’s banking details are neither accessible to the Seller nor stored on the website.

Graph’Art Studio reserves the right to refuse delivery or to honor an order from any Client with an ongoing payment dispute relating to a previous order.

An invoice will automatically be sent to the Client once the order has been confirmed.

5. Production and delivery timeframes

Once the printing medium and dimensions have been chosen by the Client, and payment has been confirmed, production of the printed artwork can begin. Once production is complete, the artwork is shipped directly to the address provided by the Client at the time of ordering, by our partner.

It is the Client’s responsibility to ensure that the delivery address provided is correct and complete. In case of error or omission, Graph’Art Studio cannot be held responsible for any delays or failure to deliver.

Upon receiving the package, the Client is advised to check its condition in the presence of the carrier. If any damage is observed, a claim must be filed with the carrier. The Client must also contact us by email, including photos, within three business days of delivery so that we can assist with the procedures for replacing the damaged product.

If no such action is taken, the Client will be deemed to have received the artworks in perfect condition, and no claim from the Client will be accepted. Signing the delivery slip without reservation constitutes acceptance that the products are compliant and in good condition.

During periods of high demand, such as the holiday season, these timeframes may be extended. Likewise, in cases of force majeure, the obligations of both parties will be adjusted or suspended accordingly.

5.2 Delivery areas, customs duties and import taxes

Delivery of the products is offered only to the destinations available at the time of ordering. If no delivery option is available for a given destination, the Customer is invited to contact Graph’Art Studio before placing the order.

For certain destinations outside the European Union, customs duties, import taxes or handling fees may be required by local authorities or the carrier at the time of delivery. These fees remain the Customer’s responsibility. It is the Customer’s responsibility to check before placing the order.

6. Returns and refunds

6.1 Delivery, damage and non-conformity

If an artwork is received damaged or non-compliant, the Customer is invited to act without delay so that their claim can be processed. For the claim to be handled, the following elements are essential:

  • write clear and specific reservations on the delivery note and, where possible, report them to the delivery person,
  • promptly inform the carrier and the Seller,
  • provide photographic evidence of the damage or non-conformity.

This procedure applies to all orders in the event of an issue identified upon delivery.

6.2 Artworks printed to order

These artworks are produced according to the characteristics selected by the Customer (dimensions, medium, finishes). Once the order has been confirmed and production has started, cancellation is no longer possible.

As these artworks are produced to the Customer’s specifications, they fall within the exceptions to the right of withdrawal referred to in Section 6.3 of these Terms and Conditions.

6.3 Exceptions to the right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods that are customized or produced to the Customer’s specifications.

7. Intellectual property

The Seller, Graph’Art Studio, retains full intellectual property rights over the artworks, unless such rights are expressly and in writing transferred. Any reproduction, distribution, broadcasting, or commercial use of the artworks without prior authorization is strictly prohibited.

7.1 Protection of website content

All data on the Graph’Art Studio website, such as the logo, images, texts, graphics, and any other work of the mind, are protected by copyright law. In accordance with Article L.122-4 of the French Intellectual Property Code, any partial or total reproduction of the website’s content, in any form whatsoever, is prohibited without the prior written consent of the Seller. Any unauthorized use of the website’s content may result in criminal prosecution.

7.2 Printed artworks

When purchasing an artwork printed on a physical medium, the Client acquires only the material ownership of the object. This does not in any way grant additional rights over the use of the artwork beyond personal enjoyment. Any reproduction, distribution, rental, or other form of exploitation, whether analog or digital, is strictly prohibited, except in cases provided for by law or with the written authorization of the Seller.

8. Client responsibilities

8.1 Compliance with laws

The Client agrees to comply with all applicable laws and regulations, particularly regarding the prohibition of distributing obscene or illegal content. Graph’Art Studio reserves the right to refuse any order containing illicit images and, in cases of non-compliance with the law, may forward the information to the competent authorities.

8.2 Use of artworks

The Client may not reproduce, distribute, or commercially exploit purchased artworks without the express authorization of the Seller, in accordance with copyright laws.

9. Seller responsibilities

9.1 Product quality and compliance

Graph’Art Studio undertakes to provide a product that matches the order. However, variations in shade or color may occur during printing, and such differences cannot be considered the Seller’s responsibility. This is due to the color calibration of the Client’s device or monitor, as well as the nature or texture of the chosen printing medium.

If the delivered product is damaged, and in order to receive assistance with the replacement process, the Client must refer to the obligations set out in Article 6 of these Terms and Conditions.

9.2 Force majeure

Graph’Art Studio cannot be held liable for delays or failure to fulfill its obligations in cases of force majeure as defined by law (natural disasters, major computer failures, strikes, etc.). This also includes situations such as telecommunications outages, unavailability of internet networks, equipment failures, fires, water damage, and any blockage of transportation or supply channels. In such circumstances, obligations will be suspended until the situation is resolved.

10. Changes to the Terms and Conditions

Graph’Art Studio reserves the right to modify these Terms and Conditions of Sale and Use at any time. Any modification will apply to orders placed after its publication on the website.
